Federal law requires that a local educational agency receiving funds under the Elementary and Secondary Education Act provide military recruiters and institutions of higher education the same access to secondary school students — and to student recruiting information — that the School provides to postsecondary institutions and to prospective employers. This policy implements that requirement and the parent/eligible-student opt-out. Because this access is required by federal law independent of FERPA, it applies to the categories below even though TSAS does not designate student addresses or telephone numbers as FERPA directory information.
Information provided on request
On request, the School provides military recruiters (the Armed Forces of the United States and the service academies) and institutions of higher education the following information for secondary school students (grades 9–12): the student’s name, address, and telephone listing — unless the parent or eligible student has opted out under this policy.
Recruiter access to students
Military recruiters receive the same access to secondary school students on School premises as the School provides to postsecondary institutions and to prospective employers. Such access is coordinated through the Head of School or designee and is conducted so as not to disrupt instruction.
Annual notice and opt-out
The School annually notifies parents and eligible students (a student who is eighteen (18) or older, or who attends a postsecondary institution) of the right to request that the student’s name, address, and telephone listing not be released to military recruiters or institutions of higher education without prior written consent. A parent or eligible student may submit that opt-out in writing to the Head of School at any time, and it remains in effect until rescinded in writing. The School provides this notice together with its annual FERPA notification.
Relationship to FERPA
This policy is separate from, and additional to, the School’s Family Educational Rights and Privacy Act (FERPA) policy. The opt-out under this policy is distinct from the FERPA directory-information opt-out; a parent or eligible student may exercise either, both, or neither.
